General Terms and Conditions of Gods Original Design

GODS ORIGINAL DESIGN (hereinafter referred to as G.O.D.), located at Rooseveltstraat 8 A5, 2321 BM Leiden.

These general terms and conditions apply to all transactions and interactions with G.O.D. This includes visiting the webshop (www.godsoriginal.design), picking up products on location, delivering and shipping products, any form of contact made via social media, or when contacting customer service.

G.O.D. acts as the provider of our products and is responsible for the terms and conditions applicable to the use of these products.

The general terms and conditions describe the agreements applicable to the use of G.O.D.'s products and/or services. This includes your rights and obligations. The purpose of these general terms and conditions is to create clarity and to promote a fair and transparent customer relationship between you and G.O.D..

Please note: These general terms and conditions may be updated periodically to reflect any changes in our policies.

      1. Applicability

1.1 These General Terms and Conditions apply to all transactions and interactions between G.O.D. ("we" or "us") and the Buyer ("you" or "your") regarding the purchase of products through our webshop www.godsoriginal.design ("Webshop") or our social media channels ("Instagram", "TikTok", and "Facebook") in connection with the G.O.D brand. By using the webshop and/or placing an order with G.O.D., the buyer accepts these General Terms and Conditions.

1.2 G.O.D. reserves the right to amend these General Terms and Conditions at any time and without prior notice. Such changes shall be effective for orders placed after the date of the amendment. It is the buyer's responsibility to regularly consult the General Terms and Conditions for any updates. 

      2.  Offer and Orders

2.1 All products offered on www.godsoriginal.design are non-binding offers, subject to availability. An agreement between the buyer and seller is established from the moment that G.O.D. confirms and accepts the buyer's order. The buyer will receive written confirmation thereof. G.O.D. reserves the right to refuse or cancel orders without providing a reason.

      3. General Product Offering

The product range includes 'new' items such as T-shirts, Hoodies, Caps, Vests, and Tracksuits. These products have not been worn or used before and are in new condition. G.O.D. guarantees the quality of all products available within the webshop.

The product offering from G.O.D. is presented online through our webshop. For this reason, the products fall under the regulation for distance selling. Photos and information provided within the webshop or on social media serve as an indication of the actual product.

The information regarding weight, dimensions, color, and images serves as an indication of the actual product. Additionally, all provided information and prices are subject to possible typographical or programming errors. Such inaccuracies do not entitle to compensation or dissolution of the agreement, unless otherwise agreed upon or if the situation falls under the return policy.

If the buyer has doubts or questions about a specific product or wishes to make changes to the order, they have the right and responsibility to contact our customer service themselves. The G.O.D. team is ready to assist the buyer and answer any questions.

     4. Customized Products

At G.O.D., we will soon offer the possibility to order customized products. To ensure smooth service, there are specific terms and responsibilities that both the buyer and G.O.D. must adhere to. Custom offers and quotations are valid for 10 days from the quotation date. Agreements regarding customized products are only considered valid when made in writing.

     4.1 Customer Responsibilities

Accurate Measurements and Design Specifications:

  • The buyer is responsible for providing accurate and complete measurements and design specifications when placing a custom order.
  • Any measurement instructions or assistance in measuring will be available on our webshop to support the buyer in providing the correct information.

Consequences of Incorrect Specifications:

  • If the buyer makes errors in specifying custom options or submitting their own designs, G.O.D. is not liable for these mistakes. This may result in products that do not fit or meet expectations.
  • In the event of incorrect specifications by the buyer, it is not possible to return or exchange the customized products.

 

4.2 Rights of G.O.D.

Refusal or Cancellation of Orders

G.O.D. reserves the right to refuse or cancel custom orders in specific situations, including but not limited to:

  • Unreasonable or unrealistic design requirements.
  • Misuse of the customization process.
  • Situations where the necessary materials or techniques are not available.

 

If a custom order is refused or canceled, G.O.D. will inform the customer and refund any payments.

 

During the production process, G.O.D. may contact the buyer for additional information or confirmations to ensure that the customized products meet the specifications.

      5. Rates and Payments 

Prices within the webshop are displayed in euros and include VAT. Payments for orders are made through the available payment methods on our webshop. G.O.D. offers the following payment options: Buckaroo, iDeal. Any additional costs, such as shipping (and return) costs, are borne by the buyer. During the checkout process, you will have the opportunity to select a shipping method of your choice.

 

If the purchased item requires a larger package size than the chosen shipping method for which payment has already been made, we reserve the right to adjust the shipping method and pass on the additional costs to you. Ownership of the products remains with us until full payment is received. Products will only be shipped after payment has been fully processed.

      6. Delivery and Collection of Products

6.1 G.O.D. aims to deliver orders within the specified delivery time. Our goal is to dispatch every order within 1 to 3 working days. However, some products may have a longer delivery time than one week (depending on current stock and our suppliers). If this is not achievable, the buyer will be promptly notified. After transferring the products to one of our transport partners, you will be informed of the final delivery date through them. Exact delivery times may vary depending on the destination of the products.

 

6.2 When it comes to customized products, the aforementioned delivery times do not apply. The delivery time for customized products may be longer than for standard products. The estimated delivery time will be communicated during the ordering process.

 

6.3 Buyers have the following delivery options:

Products are delivered by one of our shipping partners: UPS, FedEx, PostNL. We strive to make our products available worldwide. Additional costs for shipments outside the Netherlands depend on the specific delivery address.

 

6.4 Buyers have the following collection options:

Products can be collected by appointment at G.O.D.'s business location, located at Rooseveltstraat 8 A5, 2321 BM Leiden. Buyers can make an appointment to visit via info@godsoriginal.design.

 

During the checkout process, buyers can indicate which delivery option best suits their personal preferences and needs.

 

6.4.1 G.O.D. is responsible for the buyer's package until the moment the buyer (or a designated person) has received the package. Either at the specified delivery address or a pickup point. From the moment the package is received and accepted by the buyer (or the designated person), responsibility is transferred from seller to buyer.

 

In the event of delivery delays due to force majeure or other circumstances beyond our control, the buyer cannot hold G.O.D. liable. The buyer will be kept informed of such situations in writing.

 

Both G.O.D. and the buyer have the right to terminate the agreement (in a force majeure situation lasting longer than 31 days) without involving a court.

      7. Returns and Right of Withdrawal

Buyers have the right to terminate the agreement and return the products within 14 days of receipt without providing any reasons. This right is enshrined in Dutch legislation. The cooling-off period grants the buyer the right to terminate the agreement, concluded through our webshop, within 14 days of receiving the order.

 

The cooling-off period commences when:

  • The buyer (or a designated person) receives the order.
  • The buyer receives the last product of an order sent in multiple deliveries.

 

     8. Conditions for Returns

To be eligible for a return, the following conditions must be met:

  • The buyer is a natural person and is not acting in the course of a profession or business.
  • The buyer has handled the products carefully during the cooling-off period and has not used them.
  • The buyer has carefully inspected the products without using them.
  • Products must be returned within 14 days after invoking the right of withdrawal. After this period, the right to return expires.
  • Products must be returned in their original condition and packaging.
  • In case of depreciation due to usage beyond inspection, the buyer is liable for the diminished value. Additional costs will be recovered from the buyer.

 

Return Procedure

1. Requesting a Return

  • Send a written request to initiate a return via email to info@godsoriginal.design. Clearly state that you are invoking the right of withdrawal.
  • Within 1 to 2 working days, you will receive written confirmation of receipt of this request.

 

2. Sending the Return

After registration, you can return the product to:

  • Gods Original Design
  • Rooseveltstraat 8 A5
  • 2321 BM Leiden
  • Netherlands

 

Ensure that the product is returned with all supplied accessories and, if possible, in the original packaging. The costs for returning your home to the online store are at your own expense. Consult your carrier's webshop for exact rates.

 

3. Confirmation and Refund

  • You will receive a return confirmation once your return has been processed.
  • The refund will be made as soon as possible, no later than 14 days after receipt of the return. We may wait to reimburse until we have received the item or until you prove that you have shipped it.
  • Shipping and return costs are the responsibility of the buyer. These costs will not be reimbursed.

 

Product Exchanges

If you have purchased a product that you want to exchange, we offer the following options:

 

Online Exchange

After registering your return by email, you can choose to exchange the item online, except for sale items. Online exchange is only possible if the reason for return is 'item is too small' or 'item is too large':

  • Only exchange if the larger/smaller size is still in stock.
  • Only exchange if the price of the item remains the same.
  • Only exchange when only 1 size of an item has been purchased.
  • When opting for an online exchange, you are essentially placing a new order and paying the same price as your first order. Any discounts will be reapplied.
  • Payment with gift cards can only be reused once the return has been processed.

 

Exchange at Location

  • Exchange at our office is possible unless you have paid with AfterPay. Contact us in advance and check online if the desired size is still in stock to avoid disappointment.

 

Custom-Made Products and Right of Withdrawal and Return Policy

Exclusion of Right of Withdrawal:

  • Due to the nature of custom-made products, the right of withdrawal does not apply. Custom-made products cannot be returned or exchanged unless there is a manufacturing defect or an error on the part of G.O.D.

 

Quality Guarantee:

  • G.O.D. guarantees that custom-made products are manufactured according to the agreed specifications and quality standards. In case of deviations caused by G.O.D., appropriate measures will be taken to resolve the issue, such as repair, replacement, or refund.

 

AfterPay Payments

  • If you have paid with AfterPay, you will receive a first payment reminder without additional charges after 16 days. You have a total of 30 days to pay the invoice before additional charges are applied.
  • If you return something, you can also indicate this via the AfterPay app to pause your payment overview until your return has been processed.

 

  1. Warranty

The product range of G.O.D. includes 'new' products such as T-shirts, Hoodies, Caps, Vests, and Tracksuits. These products have not been worn or used previously and are in new condition. G.O.D. guarantees the quality of all products available within the webshop. Products conform to the agreement and meet the expectations that can reasonably be expected. The basis of these expectations is the available information on the product pages of the respective products.

 

G.O.D. ensures that custom-made products are manufactured according to the agreed specifications and quality standards. In case of deviations caused by G.O.D., appropriate measures will be taken to resolve the issue, such as repair, replacement, or refund.

 

As described in article 2, the buyer should be aware that all information available on the webshop and the respective product pages should be considered 'indicative'. G.O.D. aims to inform the buyer as thoroughly as possible about the product. If the buyer receives a product with any defects, the buyer should make a written notification of the defect within a reasonable time after discovery. The buyer is entitled to warranty if it is found that the product is damaged upon arrival.

 

All G.O.D. products are covered by the warranty periods offered by our supplier-manufacturers. If the product becomes defective within the warranty period, it is assumed to be faulty unless it has been used abnormally. When contacting our customer service, we will make every effort to repair or replace the product as quickly as possible.

 

  1. Intellectual Property

G.O.D. distinguishes between two forms of intellectual property:

 

  1. Intellectual Property - Product Design

G.O.D. is an independent and officially registered brand with its own product designs in the form of clothing, name, and logo designs. These designs are registered with the BBIE. The BBIE, also known as the Benelux Bureau for Intellectueel Eigendom, is the official organization responsible for trademark registration in the Benelux (Belgium, Netherlands, and Luxembourg).

 

This registration grants G.O.D. the following exclusive rights:

  • Exclusive right to use the trademark for goods and services for which the trademark is registered.
  • Protection against infringement when third parties use an identical or confusingly similar trademark for the same or similar goods and services.
  • Exclusive right to grant licenses to others to use the trademark and the related goods and services.

 

  1. Intellectual Property - Webshop Content

G.O.D. or its licensors have full intellectual property rights regarding the webshop and its content. The content is defined as: all present texts, images, logos, and software. It is not allowed to copy, distribute, or reproduce any form of intellectual property related to the webshop content (without prior written consent from G.O.D.).

 

  1. Customer Service and Complaints

For questions, remarks, or complaints, buyers can contact our customer service. G.O.D. aims to respond to your message within two business days. You can reach out to us via info@godsoriginal.design or by contacting us through any of our social media channels.

 

  1. Applicable Law and Dispute Resolution

GODS ORIGINAL DESIGN (G.O.D.) is a Dutch company located at Rooseveltstraat 8 A5, 2321 BM Leiden, registered under Chamber of Commerce number: 52469883. As this company is based in the Netherlands, Dutch law applies to the terms and conditions. Any disputes between G.O.D. and the buyer will be submitted to the competent court in the Netherlands.
